These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Client,” “you,” or “your”) and Atomic Shelf (“we,” “us,” or “our”). By subscribing to any plan, accessing our platform, or engaging our services at atomic-shelf.com, you confirm that you have read, understood, and agree to be bound by these Terms.
Definitions
“Services” means all content production, social media management, advertising management, Amazon DSP retargeting, A+ Content creation, podcast production, and any related deliverables provided by Atomic Shelf.
“Subscription Plan” means the pricing tier selected by the Client (Enhanced, Starter, Growth, Surge, or Orbit), together with the billing frequency (monthly, quarterly, semi-annual, or annual).
“Ad Budget” means the portion of the Client’s subscription fee expressly allocated to paid advertising on Amazon DSP, TikTok, or other platforms, as specified in the chosen plan.
“Platform” means atomic-shelf.com and any associated dashboards, portals, or communication tools operated by Atomic Shelf.
“Deliverables” means videos, trailers, theme songs, podcast episodes, A+ Content modules, scripts, and any other creative assets produced under a Subscription Plan.
Services Overview
Atomic Shelf provides AI-assisted book marketing services to independent authors. Depending on the Subscription Plan selected, Services may include:
- Short-form video production for TikTok, YouTube Shorts, Instagram Reels, Pinterest, and X
- Cinematic book trailers and long-form YouTube content
- Original AI-composed theme music and podcast episode production
- Social media account setup, optimisation, and ongoing management
- Amazon A+ Content production (hero banners, character panels, review modules)
- Amazon DSP retargeting campaign management
- Monthly performance reporting covering views, attribution, and sales metrics
The exact scope, volume, and deliverables applicable to your plan are as described on the Atomic Shelf pricing page, as updated from time to time.

Plans are available on month-to-month, 3-month (10% discount), 6-month (20% discount), or 12-month (25% discount) billing cycles. The applicable rate is determined at the time of subscription.
Payments are due in advance at the start of each billing cycle. All prices are stated in USD unless otherwise agreed. Atomic Shelf accepts the payment methods listed on the checkout page at the time of purchase.
Failure to pay within 7 days of the due date may result in suspension of Services. Atomic Shelf reserves the right to charge a late fee of 1.5% per month on overdue balances.
The Ad Budget included in paid plans is drawn from your subscription fee and managed by Atomic Shelf on your behalf. Unused Ad Budget in a given billing cycle does not roll over and is not refundable.
Atomic Shelf may amend pricing at any time. Existing subscribers will receive at least 30 days’ written notice before any price increase takes effect.
Cancellation & Refund Policy
You may cancel at any time. Cancellation takes effect at the end of the current billing cycle. No partial-month refunds are issued.
If you cancel a 3-, 6-, or 12-month subscription before the commitment period ends, any discount applied to paid months will be forfeited. The difference between the discounted rate paid and the standard monthly rate will be charged for months already served. No refund is issued for remaining committed months, unless required by applicable law.
Cancellation terms for Orbit plans are set out in the bespoke written agreement entered into at activation.
Atomic Shelf does not guarantee specific sales figures, ROAS, view counts, or other performance metrics. Performance statistics shown on the website are historical averages and are not contractual commitments. Failure to achieve particular marketing outcomes does not entitle the Client to a refund.
Client Obligations
You agree to:
- Provide accurate information about your book(s), genre, target audience, and any third-party rights (including publisher agreements) that may affect our ability to market your work.
- Grant Atomic Shelf a non-exclusive, royalty-free licence to use your book covers, title, author name and likeness, and excerpts solely for producing and publishing Deliverables under your plan.
- Ensure that you hold all necessary rights to the content you submit, and that such content does not infringe any third-party intellectual property, privacy, or other rights.
- Respond to reasonable requests for approvals or information within 5 business days; delays beyond this may affect production timelines without liability to Atomic Shelf.
- Comply with the terms of service of all third-party platforms on which content is published (including TikTok, YouTube, Amazon, Meta, Pinterest, and X).
- Not use the Services to promote content that is unlawful, defamatory, obscene, or otherwise in violation of applicable laws or third-party platform policies.
Intellectual Property
Upon receipt of full payment for the billing cycle in which they were produced, ownership of Deliverables (videos, scripts, music, A+ Content modules) transfers to you.
Atomic Shelf retains a perpetual, worldwide, royalty-free licence to display Deliverables in its portfolio, case studies, and marketing materials, unless you request in writing that a specific Deliverable be excluded.
Atomic Shelf’s proprietary AI pipeline, production methodologies, system architecture, and brand assets remain the exclusive property of Atomic Shelf. Nothing in these Terms transfers any rights to Atomic Shelf’s underlying technology.
Deliverables may incorporate outputs from licensed AI generation tools. Atomic Shelf warrants that it operates such tools within their applicable licence terms. Atomic Shelf makes no representation that AI-generated content is registrable as a copyright work in any jurisdiction. You should seek independent legal advice if copyright registration is important to you.
Amazon DSP & Third-Party Advertising
Atomic Shelf manages Amazon DSP campaigns on your behalf as a Certified Amazon DSP Partner. Campaign strategy, audience targeting, creative selection, and spend pacing are within Atomic Shelf’s reasonable discretion, exercised in good faith to optimise your Ad Budget.
All DSP campaigns are subject to Amazon Advertising’s current policies and guidelines, which Amazon may modify at any time. Atomic Shelf reserves the right to decline or modify any campaign brief that would violate such policies.
DSP performance depends on warm audience size, market conditions, Amazon ad inventory availability, and other factors outside Atomic Shelf’s control. Published ROAS figures are historical averages only and are not guarantees of future performance.
Atomic Shelf will provide monthly performance reports covering key attribution metrics. All data is sourced from Amazon and other platforms and reflects their inherent measurement limitations. Atomic Shelf is not responsible for inaccuracies in platform-reported data.
Confidentiality
Each party agrees to hold the other’s confidential information — including business strategies, client data, pricing structures, and proprietary methodologies — in strict confidence and not to disclose it to third parties without prior written consent. This obligation survives termination of these Terms for three (3) years. Information that is publicly known, independently developed, or required to be disclosed by applicable law is not subject to this obligation.
Data Protection & Privacy
Atomic Shelf collects and processes personal data in accordance with its Privacy Policy, available at atomic-shelf.com. By using the Services, you consent to such processing. Atomic Shelf implements reasonable technical and organisational measures to protect personal data against unauthorised access, loss, or destruction. Atomic Shelf does not sell personal data to third parties.
To the extent that the UK GDPR, EU GDPR, or other applicable data protection laws apply to information you provide, Atomic Shelf acts as data controller for account and billing data, and as data processor for any author or book-related content submitted solely for the purpose of producing Deliverables.
Limitation of Liability
Nothing in these Terms limits or excludes liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any liability that cannot be excluded or limited by applicable law.
Warranties & Disclaimers
Atomic Shelf warrants that it will provide the Services with reasonable skill and care consistent with industry standards.
Atomic Shelf does not warrant that: (a) the Services will be uninterrupted or error-free; (b) any specific sales, audience growth, or revenue outcome will be achieved; or (c) third-party platforms will maintain their current policies, algorithms, or availability.
Termination
You may cancel your Subscription Plan in accordance with Section 4.
Atomic Shelf may suspend or terminate your account immediately and without liability if: (a) you materially breach these Terms and fail to remedy the breach within 14 days of written notice; (b) you have provided false or materially misleading information; (c) your use of the Services violates applicable law or third-party platform terms; or (d) you engage in sustained abusive or harassing conduct toward Atomic Shelf personnel.
Upon termination: (a) all licences granted to Atomic Shelf cease, subject to the portfolio licence in Section 6.2; (b) outstanding fees for services rendered become immediately due; and (c) Atomic Shelf will provide you with completed Deliverables for fully paid billing cycles within 14 days of termination.
Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of England and Wales.
The parties will first attempt to resolve any dispute informally by notifying nick@atomic-shelf.com with a written description of the dispute. The parties will negotiate in good faith for 30 days.
If a dispute is not resolved informally within 30 days, the parties submit to the exclusive jurisdiction of the courts of England and Wales, except that Atomic Shelf may seek injunctive or other equitable relief in any competent jurisdiction.
General Provisions
These Terms, together with any Subscription Plan confirmation and (for Orbit plans) the bespoke written agreement, constitute the entire agreement between the parties regarding the Services and supersede all prior representations, negotiations, or understandings.
Atomic Shelf may update these Terms at any time. Updated Terms will be posted at atomic-shelf.com with a revised effective date. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
Failure to enforce any provision of these Terms on one occasion does not constitute a waiver of the right to enforce it on a future occasion.
If any provision of these Terms is found invalid or unenforceable, it shall be modified to the minimum extent necessary to make it enforceable. All other provisions remain in full force and effect.
You may not assign your rights or obligations under these Terms without Atomic Shelf’s prior written consent. Atomic Shelf may assign these Terms to a successor entity in connection with a merger, acquisition, or sale of substantially all its assets.
Atomic Shelf will not be in breach of these Terms or liable for delays or failures resulting from events beyond its reasonable control, including platform outages, acts of God, government action, or internet infrastructure failures, provided it notifies you promptly.
Formal notices to Atomic Shelf must be sent to nick@atomic-shelf.com. Notices to you will be sent to the email address associated with your account and are deemed delivered 24 hours after sending.
Nothing in these Terms creates a partnership, joint venture, agency, franchise, or employment relationship between the parties. Atomic Shelf is an independent contractor.
